Terms of Service

1. Eligibility

You must be at least 13 years old to use Embed. By using the App, you represent that you meet this age requirement. If you are between 13 and 18, you must have permission from a parent or guardian.

2. Account Registration

To use the App, you must create an account with a valid email address and password. You are responsible for keeping your login credentials secure and for all activity that occurs under your account.

3. Description of Service

Embed is a language learning app that provides:

• Flashcard-based study with spaced repetition
• AI-powered tutoring chat for grammar and vocabulary questions
• AI-powered speaking practice in simulated real-world scenarios
• Progress tracking and lesson curriculum

Some features use third-party artificial intelligence services (OpenAI, Deepgram, ElevenLabs) to process your input and generate responses. AI-generated content may not always be accurate. You should not rely on AI responses as your sole source of language instruction.

4. Subscriptions and Payments

Embed may offer free and paid subscription tiers. If you purchase a subscription:

• Payment will be charged to your selected payment method at confirmation of purchase
• Subscriptions automatically renew unless you cancel before the renewal date
• You can manage or cancel your subscription through your account settings or your device's app store settings
• Refunds are handled according to the policies of the Apple App Store or the applicable payment provider

5. Acceptable Use

When using Embed, you agree not to:

• Use the App for any unlawful purpose
• Attempt to manipulate or abuse the AI features to generate harmful, offensive, or inappropriate content
• Interfere with or disrupt the App's operation or servers
• Share your account credentials with others
• Reverse-engineer, decompile, or disassemble any part of the App

6. Intellectual Property

All content in the App — including lesson materials, flashcard content, curriculum structure, UI design, and branding — is owned by IDK Studios, Inc. and is protected by copyright and intellectual property laws. You may not copy, distribute, or reproduce any part of the App without our written permission.

Content you create within the App (such as custom flashcards or conversation messages) remains yours, but you grant us a license to store and process it as needed to provide the service.

7. Third-Party AI Services

The App uses third-party AI services to power certain features. By using these features, you acknowledge that:

• Your text input, voice recordings, and conversation context may be sent to OpenAI, Deepgram, and ElevenLabs for processing
• These services have their own terms and privacy policies
• AI responses are generated automatically and may contain errors or inaccuracies
• We are not responsible for the content of AI-generated responses

8. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that AI-generated content will be accurate or suitable for any particular purpose.

9. Limitation of Liability

To the maximum extent permitted by law, IDK Studios, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of profits, or reliance on AI-generated content.

10. Account Termination and Deletion

We reserve the right to suspend or terminate your account if you violate these Terms. You may also delete your account at any time by going to Profile in the App and tapping "Delete Account." Upon account deletion, all of your personal data — including study progress, conversation history, and review history — will be permanently deleted within 30 days in accordance with our Privacy Policy.

11. Indemnification

You agree to indemnify, defend, and hold harmless IDK Studios, Inc. and its officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including reasonable attorney fees) arising from your use of the App, your violation of these Terms, or your violation of any rights of a third party.

12. Dispute Resolution

Any dispute arising from or relating to these Terms or your use of the App shall first be attempted to be resolved through informal negotiation by contacting us at support@tryembed.app. If the dispute cannot be resolved informally within 30 days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association.

You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action, class arbitration, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against IDK Studios, Inc.

13. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes by posting the updated Terms within the App. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

14. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or your use of the App shall be resolved in accordance with applicable law.
